The new regime applies to all regulated contracts whose procurement was commenced on or after 24 February 2025. Generally, a procurement will be commenced on the date that the contract notice/advertisement is published. 

The Procurement Act 2023 is organised in a logical way, from key principles at the start, through pre-procurement, procurement processes and award, contract management, to remedies and oversight.

The guidance note outlines key considerations for purchasing clinical NHS healthcare services under the Health Care Services (Provider Selection Regime) Regulations 2023 effective from 1 January 2024.

Transparency

The requirement to publish a much greater range of transparency notices is one of the key changes under the Act. Our briefing lists out all the notices required under the Act and indicates whether or not these are mandatory.

    • Anyone working in or advising the public sector should be able to register with Government Commercial College.
    • There is a 10-module training course on the Procurement Act 2023, including resources and leading to a certificate. There are also Communities of Practice, discussion forums and presentations on a wide range of relevant topics.

  • Provider Selection Regime
    • From 1 January 2024, the Provider Selection Regime comes into force for the procurement of NHS healthcare services; the Public Contracts Regulations 2015 will no longer apply in relation to these services from 1 January 2024.
