What are the staffing implications of buying in support services?

By the end of October, CCGs and CSUs were to clarify what level of support and resources would be available for commissioning support services. This included CCGs selecting a CSU that they will use after the PCTs and SHAs have been abolished.

The Service Level Agreements between the CCGs and CSUs are to be signed by the end of November. This will then allow for both CCGs and CSUs to be clear as to their staffing structures.

NHSCB will expect these bodies to recruit in line with the national HR transition process. This highlights the need for the legal requirements of the Transfer of Undertakings (Protection of Employment) Regulations and the Cabinet Office 'Staff Transfers in the Public Sector Statement of Practice' to be followed.

The HR Transitional Framework states:

"employees who are substantially performing the duties that are to be transferred...would normally transfer to the new organisation with their contractual terms including continuity of service protected."

Therefore consideration of the staffing implications of procuring services should be carefully thought through before finalising the SLAs.
