NHS bodies and local authorities partnership arrangements going forward

On 17 December The NHS Bodies and Local Authorities (Partnership Arrangements, Care Trusts, Public Health and Local Healthwatch) Regulations 2012 were laid before Parliament (the 2012 Regulations).

Part 2 of the 2012 Regulations:

  • includes the consequential amendments to the NHS Bodies and Local Authorities Partnership Arrangement Regulations 2000 (the 2000 Partnership Regulations) following the Health and Social Care Act 2012; and
  • prescribes certain functions of CCGs and the NCB (the Board) (and Local Health Boards) for the purposes of section 76(1) of the National health Service Act 2006.

The amendments to the 2000 Partnership Regulations include changes to the list of prescribed NHS bodies removing Primary Care Trusts and adding CCGs and the NCB. References to PCTs' health improvement plans are also removed.

In any partnership arrangement made between NHS bodies and local authorities the partnership arrangements must now include provision for the sharing of information between NHS bodies and local authorities.

Finally The National Health Service (Payments by Local Authorities to NHS Bodies) (Prescribed Functions) Regulations 2000 are revoked by Regulation 13 which now prescribes the functions of the NCB CCGs and Local Health Boards for the purposes of section 76(1) of the 2006 Act (power of local authorities to make payments).
