What can I do for you?
I have wide experience of working in all areas of commercial litigation with a particular interest in contentious procurement for both suppliers and contracting authorities. I represented the successful party in the first case before the English court dealing with the lifting of the automatic suspension under the Procurement Regulations 2006 (as amended) and I have dealt with all aspects of contentious procurement work including advice on confidentiality rings and disclosure under the Freedom of Information Act.
My commercial litigation work is very varied ranging from the traditional, such as complex breach of contract litigation in the High and Appellate Courts, international arbitration and mediation, to the less obvious such as helping with strategic decisions relating to a client’s business, risk management and advice in connection with specialist tribunals. My clients reflect this broad range of work and include listed companies, SMEs and clients within our specialist health and education practices.
Supporting my clients’ objective
Litigation is often regarded as a “distress purchase”. However, there is very little more satisfying than steering a client with a genuinely good case through a complex matter and achieving a result before the court or tribunal, which ensures the survival of the business.
One of my most satisfying cases came when I defended a client from a claim against them that started at about £7 million, but which, by the first day of the arbitration, had increased to approximately £25 million. After three weeks the claim was dismissed with costs against the claimant. I also enjoy the sheer variety of cases which cross my desk from a defective potato harvest to on-line bingo.
I have been involved in advising on a number of substantial disputes arising out of the Public Contract Regulations. I have both brought and defended procurement claims in the TCC and was recently involved in a wide ranging and high profile challenge to a procurement decision of national significance by the Legal Aid Agency on behalf of a number of clients. I have also advised on collateral challenges to procurement decisions by way of judicial review and to NHS Information.
